INFORMATION ON SENDING COMMERCIAL ELECTRONIC MESSAGES
Pursuant to Law No. 6563 on the Regulation of Electronic Commerce and relevant legislation, a commercial electronic message refers to data, voice, and video content sent for commercial purposes via electronic means, including telephone, call centers, fax, automated calling machines, intelligent voice recorders, email, and short message services (SMS).
Commercial electronic messages may only be sent to recipients after obtaining their prior consent. Messages cannot be sent to recipients who do not have valid approval recorded in the Commercial Electronic Message Management System (IYS). Consent may be obtained in writing, via any means of electronic communication, or through the IYS (once the system becomes available). Approvals obtained through IYS must include an affirmative declaration of intent and the electronic communication address.
Recipients may withdraw their consent at any time without giving any reason. A rejection notice invalidates the approval for the specific communication channel through which it was submitted. Recipients may also use the IYS to exercise their right of refusal (once the system becomes available).
If a recipient provides their contact information for the purpose of being contacted, no additional consent is required for commercial electronic messages related to updates, usage, or maintenance of goods or services supplied.
Consent is not required for commercial electronic messages sent to merchants or tradespeople. However, if these recipients exercise their right of refusal as specified in the legislation, no messages may be sent without their approval. In this context, before sending messages, service providers must register the electronic contact addresses of merchants/tradespeople to the IYS and check whether the recipient has exercised their right to refuse.
In accordance with Law No. 6563 and related legislation, and within the scope of services provided by DATACOSMOS, if you grant your consent, we may contact you via any communication tool (such as SMS, email, telephone, fax, or call center) for the purpose of delivering notifications, promotional content, advertisements, product offers, campaigns, customer satisfaction surveys, and announcements based on the information you have provided.
Even if you have given prior consent for commercial electronic messages under Law No. 6563, you have the right to refuse such messages at any time and without giving any reason. Please note that you may send your rejection notice through the same communication channel by which the message was sent, easily and free of charge. You may also exercise this right via the IYS (once the system is available).
